Everyday workwear
Legal information
Terms & Conditions
These terms explain how orders placed with Southport Workwear are handled. They apply to purchases made through our website and to orders agreed with our team by telephone, email or pro forma invoice.
Last updated: 1 September 2026
Please read these terms before placing an order. Some provisions apply only to consumers and others only to customers buying wholly or mainly for business purposes. We identify those provisions clearly below.
Nothing in these terms limits any legal rights that cannot lawfully be limited. Our Returns & Exchanges Policy and Delivery & Collection information should be read alongside these terms.
1. About us

2. Definitions
In these terms:
- Consumer means an individual acting for purposes wholly or mainly outside their trade, business, craft or profession.
- Business Customer means a person or organisation acting for purposes relating wholly or mainly to their trade, business, craft or profession.
- Customised Goods means goods embroidered, printed, personalised, altered or otherwise made to a customer’s specification.
- Plain Goods means goods that have not been customised or altered.
- Order means an order for goods or services placed through our website or agreed with us by telephone, email, quotation or pro forma invoice.
- Working Day means Monday to Friday, excluding public holidays in England.
References to “we”, “us” and “our” mean Southport Workwear Ltd. References to “you” and “your” mean the person or organisation placing the Order.
3. Scope and contract documents
3.1 These terms apply to Orders placed through southportworkwear.com and Orders agreed directly with our team, unless we expressly agree different written terms with you.
3.2 The contract between us consists of:
- the Order confirmation or accepted quotation;
- any approved artwork proof or written product specification;
- these Terms & Conditions;
- our Returns & Exchanges Policy; and
- the delivery information and other policies expressly referred to in these terms.
3.3 If the Returns & Exchanges Policy gives you a more generous return or exchange right than these terms or the legal minimum, we will honour that more generous promise.
3.4 Business customers: Any terms contained in your purchase order or other document do not apply unless we expressly agree to them in writing.
4. Products and product information
4.1 We take reasonable care to describe and display our products accurately. Product photographs are illustrative, and colours may vary slightly because of screen settings, lighting, dye batches or normal manufacturing variation.
4.2 Measurements and size guides are supplied to help you choose. Sizing can vary between brands and styles, so you should check the guide for the particular product rather than relying only on a size normally worn in another garment.
4.3 Minor variations in measurements, shade, texture, stitching, finish and component detail may occur within normal manufacturing tolerances. We may make a reasonable, non-material change to a product where required by law or where a manufacturer changes a minor specification without materially changing the product’s function or quality.
4.4 If a particular colour, measurement, feature, standard or compatibility is essential, please tell us before ordering so we can confirm it where reasonably possible.
4.5 Product availability and any estimated fulfilment date are confirmed according to the selected colour, size and quantity. A parent product may contain both stocked and special-order variations.
5. Prices and delivery charges
5.1 The price payable is the price shown when you place your Order or the price stated in a quotation or pro forma invoice accepted by you.
5.2 Southport Workwear is not currently registered for VAT. The prices displayed on our website are therefore the total prices payable for the goods, excluding any separately stated delivery charge. We do not currently add VAT to your Order.
5.3 Delivery charges and available delivery methods are shown at checkout or stated in your quotation before you commit to the Order. At the date of these terms, qualifying UK-mainland Orders over £100 receive free standard delivery. Any exclusions or additional charges for a destination or service will be shown before the Order is placed.
5.4 We may change prices and delivery charges at any time, but a change will not affect an Order we have already accepted.
5.5 We try to ensure prices are accurate. If an obvious pricing error is discovered before acceptance, we will tell you and give you the option to order at the correct price or cancel. If we accept an Order where a pricing error could reasonably have been recognised as an error, we may cancel it and refund any amount paid.
6. Placing and accepting orders
6.1 Please check your product, colour, size, quantity, delivery details and any customisation choices before submitting an Order. Our online checkout allows you to review and correct information before payment.
6.2 Your Order is an offer to purchase the goods or services shown. An automated receipt or payment acknowledgement does not by itself mean that we have accepted the Order.
6.3 We accept an Order when we send an Order confirmation that confirms acceptance, when we tell you in writing that the Order has been accepted, or when we dispatch the goods, whichever happens first. A contract is formed at that point.
6.4 For an Order placed against a quotation or pro forma invoice, the contract is formed when we receive cleared payment and confirm acceptance of the Order.
6.5 We may decline an Order before acceptance, including where goods are unavailable, payment has not been authorised, delivery is not available to the requested address, a price or description contains an obvious error, or requested customisation is unlawful, offensive, technically unsuitable or may infringe another person’s rights.
6.6 If we cannot accept an Order, we will tell you and refund any payment taken for it.
7. Payment
7.1 Orders must be paid in full before goods are dispatched, ordered from a supplier or put into customisation, unless we have expressly agreed otherwise in writing for a particular Order.
7.2 Website Orders are paid through the payment methods offered at checkout. Orders agreed by quotation or invoice are payable pro forma using the payment method stated on the document.
7.3 We do not currently offer credit accounts. A purchase order does not create credit terms or remove the requirement for cleared payment before fulfilment.
7.4 You must provide complete and accurate billing information and must be authorised to use the payment method provided.
8. Customisation and artwork
8.1 You are responsible for checking the spelling, wording, colours, layout and other details shown in an artwork proof before approving it. Production will normally begin only after final approval and cleared payment.
8.2 A proof is intended to show the proposed design and approximate positioning. Screens display colour differently, and embroidery thread, garment fabric and printing processes can produce reasonable differences from an on-screen proof. Exact positioning and scale may also vary slightly within normal production tolerances.
8.3 You confirm that you own, or have permission to use, every name, logo, image, design, trade mark and other material you ask us to reproduce. You grant us a limited licence to use that material as necessary to prepare proofs and fulfil your Order.
8.4 We may refuse or pause customisation that we reasonably believe is unlawful, defamatory, discriminatory, offensive, technically unsuitable, unsafe or likely to infringe another person’s rights.
8.5 We are responsible for producing the approved customisation with reasonable care and skill. We are not responsible for an error that appeared clearly in a proof you approved, unless we introduced that error after approval or failed to follow an agreed written instruction.
8.6 If you delay in supplying suitable artwork, responding to questions or approving a proof, any estimated completion or delivery date will move accordingly.
8.7 Business customers: You will reimburse us for reasonable losses and costs resulting from a third-party claim that material supplied or authorised by you infringes that third party’s intellectual property rights, except to the extent the claim results from our own alteration or misuse of the material.
9. Availability and fulfilment
9.1 We distinguish between three normal fulfilment routes:
- Stocked Plain Goods: selected colour and size variations physically held by Southport Workwear may qualify for same-Working-Day dispatch when ordered before 3pm on a Working Day.
- Special-order Plain Goods: goods obtained from a supplier are normally dispatched within approximately 3–5 Working Days.
- Customised Goods: these are normally completed within approximately 5–7 Working Days from final artwork approval.
9.2 These periods are estimates unless we expressly agree a guaranteed date. The estimated date shown for a selected variation, quantity and delivery method takes priority over a general estimate.
9.3 If the quantity ordered exceeds the stock we physically hold, we may obtain the balance from a supplier. We will not represent the entire quantity as immediately dispatchable where it is not.
9.4 If an item becomes unavailable after acceptance, we will contact you. We may offer a revised timescale, a suitable alternative or cancellation of the affected item with a full refund.
9.5 If an Order contains goods with different lead times, we normally hold the Order and dispatch it together when every item is ready. Please contact us before ordering if split delivery is important; an additional delivery charge may apply.
10. Delivery and collection
10.1 Current delivery services, destinations, charges, collection arrangements and estimated dates are explained on our Delivery & Collection page and shown at checkout where applicable.
10.2 You are responsible for providing a complete and accurate delivery address and for ensuring that someone can receive the goods where required. We are not responsible for delay or loss caused by an incorrect or incomplete address supplied by you.
10.3 If delivery cannot be completed, the courier may leave instructions, attempt redelivery or return the parcel to us. We may charge the reasonable cost of redelivery where the failure was caused by an incorrect address, refusal without a legal right to refuse, or nobody being available after reasonable delivery attempts.
10.4 If you choose collection, we will tell you when the Order is ready. Please do not travel to collect until availability has been confirmed. We may ask for the Order number and reasonable identification.
10.5 Consumers: Unless a different period has been agreed, we will deliver without undue delay and no later than 30 days after the contract is formed. Your legal rights apply if we miss an agreed or legally required delivery date.
10.6 Business customers: Unless expressly agreed in writing, delivery dates are estimates and time is not of the essence. This does not remove any right to cancel after a material delay where we have failed to deliver within a reasonable additional period you have given us.
11. Risk and ownership
11.1 Consumers: Responsibility for loss of or damage to goods passes to you when you, or a person you nominate other than the carrier, takes physical possession of them.
11.2 Business customers: Responsibility for loss of or damage to goods passes to you when delivery is completed at the agreed address or when the goods are collected by you or your carrier.
11.3 Ownership of goods passes to you only when we have received payment in full for them. This does not affect the passing of risk described above.
12. Cancelling before fulfilment
12.1 Contact us immediately if you need to cancel or change an Order. We will do our best to help, but a change is not agreed until we confirm it in writing.
12.2 Plain Goods may normally be cancelled before dispatch. If they have already been dispatched, the applicable return rights in clauses 13 and 14 will apply.
12.3 Customised Goods cannot normally be cancelled once embroidery, printing, alteration or other customisation has begun. If production has not begun, we will do our best to cancel or amend the Order.
12.4 Where we agree to a change that increases or reduces the price, the difference must be paid or will be refunded before the Order proceeds.
12.5 Nothing in this clause affects a Consumer’s statutory rights, including rights relating to faulty goods or services not performed with reasonable care and skill.
13. Our 30-day returns and exchanges promise
13.1 Our Returns & Exchanges Policy provides an additional commercial promise for eligible Plain Goods. It applies whether you are a Consumer or a Business Customer and whether the item was held in our warehouse or ordered from a supplier.
13.2 You must tell us within 30 days after delivery or collection that you want to return or exchange an eligible item, then send or bring it back within 14 days after contacting us.
13.3 To qualify under this additional promise, goods must be clean, unworn, unwashed, unaltered and in a condition suitable for resale, with original tags, accessories and packaging. Footwear must have been tried only indoors on a clean surface, and its box must not be damaged or used as the postal packaging.
13.4 The additional change-of-mind promise does not cover:
- Customised Goods;
- goods worn for work, washed, marked, damaged or altered after delivery;
- goods missing essential parts, tags or packaging where this materially affects resale; or
- sealed goods that cannot be returned for health or hygiene reasons after the seal has been broken.
13.5 For a change-of-mind return or exchange, you pay the cost of returning the goods to us. For the first eligible exchange arising from an Order, we pay the standard delivery charge for sending the replacement to you.
13.6 We do not charge a restocking or handling fee for an eligible return. We normally process an agreed refund to the original payment method within five Working Days after receiving and checking the return.
13.7 The conditions of this additional promise do not restrict the separate legal rights described in clauses 14 and 15.
14. Consumer distance-selling cancellation rights
Consumers: This clause applies only when a Consumer buys at a distance, including through our website, by telephone or by email.
14.1 In addition to our 30-day promise, you normally have a legal right to cancel a qualifying distance contract without giving a reason. The cancellation period ends 14 days after the day on which you, or a person nominated by you other than the carrier, receives the goods. For an Order delivered in separate instalments, the period normally runs from receipt of the last item or instalment.
14.2 To cancel, tell us clearly before the cancellation period expires. You may email info@southportworkwear.com, write to our address in clause 1, telephone us on 01704 829966, or use the model cancellation form in clause 27. Use of the form is optional.
14.3 You must send or bring the goods back without undue delay and no later than 14 days after telling us that you are cancelling. You are responsible for the direct cost of returning change-of-mind goods unless we have agreed otherwise.
14.4 You may inspect and try goods as you reasonably could in a shop. We may reduce the refund to reflect any reduction in value caused by handling beyond what is necessary to establish the goods’ nature, characteristics and functioning.
14.5 We will refund the price paid and, when the complete Order is cancelled, the cost of our least expensive standard outbound delivery service. We do not have to refund the additional cost of a premium delivery option. Returning only part of an Order does not normally entitle you to a refund of the original delivery charge.
14.6 We will make the refund without undue delay and no later than 14 days after we receive the goods back or, if earlier, 14 days after you provide evidence that you sent them back. We may withhold the refund until we receive the goods or evidence of return. Refunds are made using the original payment method unless expressly agreed otherwise.
14.7 The statutory change-of-mind cancellation right does not apply to:
- goods made to your specifications or clearly personalised, including embroidered, printed or altered goods; or
- sealed goods that are not suitable for return for health-protection or hygiene reasons once unsealed.
14.8 These exceptions do not remove your rights where goods are faulty, not as described, incorrectly supplied, or where customisation does not match the approved Order because of our error.
15. Faulty, damaged or incorrect goods
15.1 Please contact us promptly if goods arrive damaged, develop a fault, are not as described or are not what you ordered. Tell us your Order number and what has gone wrong. Photographs may help us resolve the issue more quickly.
15.2 If the problem is a fault or our mistake, we will cover the reasonable cost of returning the goods and provide the remedy required by law, which may be a repair, replacement, price reduction or refund depending on the circumstances.
15.3 Please report visible courier damage within 48 hours where reasonably possible so that we can investigate promptly. This request does not reduce your legal rights if you contact us later.
15.4 Consumers: Goods must be as described, of satisfactory quality and fit for a particular purpose made known to us where you reasonably relied on our advice. Consumer remedies can include a short-term right to reject qualifying faulty goods within 30 days and rights to repair, replacement, price reduction or final rejection in the circumstances set out by law.
15.5 A manufacturer’s warranty is additional to, and does not replace, your rights against us.
16. Business-customer inspection and claims
Business customers: This clause applies only to Business Customers.
16.1 Please inspect goods as soon as reasonably practicable after delivery and notify us promptly of shortages, incorrect items, transit damage or defects that a reasonable inspection would reveal.
16.2 Where reasonably possible, visible delivery damage or shortages should be reported within five Working Days. Failure to meet that requested period does not prevent a claim for a latent defect that could not reasonably have been discovered earlier.
16.3 You must give us a reasonable opportunity to inspect the goods and investigate the claim before arranging repair, disposal or replacement by somebody else.
16.4 Subject to clause 20 and any rights that cannot lawfully be excluded, our obligation for goods that do not conform to the contract is to repair or replace them, refund the affected price, or provide another remedy we agree with you.
17. Product use, care and safety
17.1 You must follow applicable product instructions, care labels, warnings and manufacturer guidance. Normal wear, accidental damage, misuse, unsuitable laundering, unauthorised alteration and use outside a product’s stated specification are not product faults.
17.2 Workwear and personal protective equipment must be selected for the actual task, hazard and working environment. Product standards and performance claims apply only as stated by the manufacturer and may depend on correct sizing, fitting, use, maintenance and replacement.
17.3 If you tell us the intended use and ask for advice, we will provide that advice with reasonable care and skill. Unless we have expressly agreed to carry out a formal assessment, you remain responsible for the workplace risk assessment and for confirming that the selected product meets the requirements of the task and applicable workplace rules.
17.4 Customisation or alteration can affect the performance or certification of some protective garments. We may refuse work that we believe would make a product unsafe or conflict with manufacturer guidance.
17.5 Nothing in this clause excludes responsibility where a product is unsafe, defective or not fit for a purpose that you made known to us and for which you reasonably relied on our advice.
18. Intellectual property
18.1 You retain ownership of artwork and other original material you supply. The limited licence in clause 8.3 ends when it is no longer reasonably necessary to fulfil the Order or handle related records and claims.
18.2 Copyright, trade marks and other rights in our website, photographs, copy, graphics, proofs, templates and original design work belong to us or our licensors. You may not reproduce or commercially use them without permission, except as allowed by law.
18.3 Unless we agree otherwise, any setup, digitising or origination charge pays for the work required to prepare your Order; it does not transfer ownership of our production files, embroidery programs, templates or production methods.
19. Our responsibility to consumers
Consumers: This clause applies only to Consumers.
19.1 We are responsible for losses you suffer that are a foreseeable result of our breach of contract or failure to use reasonable care and skill. A loss is foreseeable if it was an obvious consequence or if both sides knew it might happen when the contract was formed.
19.2 We are not responsible for business losses where you are acting as a Consumer, including loss of profit, revenue, business, opportunity or business interruption.
19.3 Nothing in these terms excludes or limits responsibility for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- breach of your statutory rights in relation to goods or services;
- defective products where liability cannot lawfully be excluded; or
- anything else that the law does not permit us to exclude or limit.
20. Our responsibility to businesses
Business customers: This clause applies only to Business Customers.
20.1 Nothing in these terms limits or excludes liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- breach of the terms implied by section 12 of the Sale of Goods Act 1979;
- liability for defective products that cannot lawfully be excluded; or
- anything else that cannot lawfully be limited or excluded.
20.2 Subject to clause 20.1, we are not liable for indirect or consequential loss, or for loss of profit, revenue, anticipated savings, business, contracts, opportunity, goodwill, reputation or data.
20.3 Subject to clause 20.1, our total liability arising from or connected with an Order, whether in contract, tort (including negligence), breach of statutory duty or otherwise, will not exceed the total price paid or payable for that Order.
20.4 The limitations in this clause apply only so far as they are reasonable and permitted by law.
21. Events outside our reasonable control
21.1 We are not responsible for delay or failure caused by an event outside our reasonable control, including severe weather, fire, flood, epidemic, industrial action, transport or courier disruption, interruption of utilities or communications, import restrictions, government action or an unexpected supplier failure that we could not reasonably avoid.
21.2 We will take reasonable steps to reduce the effect of the event and will contact you where it materially delays your Order. Our obligations are suspended for the duration of the event.
21.3 If the delay becomes substantial, you may contact us to cancel the affected part of the Order and receive a refund for goods or services not supplied. Consumers retain any earlier right to cancel provided by law.
22. Website use
22.1 You may use our website only for lawful purposes. You must not attempt to gain unauthorised access, introduce malicious code, interfere with the website, scrape it in a way that unreasonably burdens our systems, or use its content in infringement of our rights or another person’s rights.
22.2 We take reasonable care over website content but cannot promise that the site will always be available or entirely free from errors. We may suspend access for maintenance, security or operational reasons.
22.3 Links to third-party websites are provided for convenience. We are not responsible for their content or availability.
22.4 Website-use provisions may be updated from time to time. Changes do not retrospectively alter a contract for an Order already accepted.
23. Personal information
We use personal information in accordance with our Privacy Policy & Cookies information, including to process Orders, take payment, arrange delivery, provide customer service and meet legal obligations.
24. Complaints
24.1 Please contact us first so we have an opportunity to resolve the problem:
Email: info@southportworkwear.com
Telephone: 01704 829966
Post: Southport Workwear Ltd, Unit 19 Dalweb Industrial Estate, Gravel Lane, Banks, Southport, Lancashire, PR9 8DE
24.2 Please include your Order number, contact details and a clear description of the issue. We will investigate and respond as soon as reasonably possible.
24.3 Consumers: If a complaint cannot be resolved through our internal process, we will provide information about an appropriate approved alternative dispute resolution body where required by law. We are not currently committed to using a particular ADR provider unless we agree or are required to do so.
25. General terms
25.1 The version of these terms in force when we accept your Order applies to that contract. We may update the terms for future Orders.
25.2 If a court or relevant authority finds part of these terms unlawful or unenforceable, the remaining provisions continue to apply.
25.3 A delay in enforcing a right does not waive that right.
25.4 No person other than you and us has a right to enforce the contract, except that a person receiving goods as a gift may rely on applicable product guarantees and statutory rights where the law allows.
25.5 You may transfer your rights under the contract only with our written agreement, except where the law allows otherwise. We may transfer our rights and obligations to another organisation, but this will not reduce a Consumer’s rights under the contract.
25.6 These terms do not prevent either party from relying on a fraudulent statement. Business customers: Subject to that exception, the contract documents listed in clause 3 contain the entire agreement relating to the Order.
26. Governing law and courts
26.1 These terms and each contract are governed by the law of England and Wales.
26.2 Consumers: You may bring legal proceedings in the courts of the part of the United Kingdom where you live. If you live in Scotland, Northern Ireland or another country, you also retain any mandatory legal protections that apply to you.
26.3 Business customers: The courts of England and Wales have exclusive jurisdiction over disputes arising from or connected with the contract.
27. Model cancellation form
Consumers: Complete and return this form only if you wish to cancel a qualifying distance contract. You do not have to use this form; a clear statement by email, post or telephone is sufficient.
